‘Why Justice Ekwo struck out Umahi’s motions for stay of execution’ – Nwaze

The elder brother to the Ebonyi State Governor and lawyer to the state government, Roy Nwaze, on Monday, gave reasons why the trial judge of the Federal High court sitting in Abuja, Justice Inyang Ekwo struck out motions seeking for a stay of execution by David Umahi and his Deputy Eric Kelechi Igwe.

Nwaze was reacting to the ruling by the Federal High court judge, wherein governor Umahi’s counsel applied for a withdrawal of the motion for stay of execution.

According to him: “The position of things is simply that the records of the appeals filed by Governor Umahi (and his Deputy) and the House of Assembly members have been transmitted to the Court of Appeal, Abuja and the appeals have been duly entered in that Court as Appeal Nos 274 and 275.

Investigations revealed that the citizens of Ebonyi State were jubilating over the striking out of the motions, misconstruing it to be a denial of Umahi’s quest to remain in office.

Nwaze noted: “The appeals having been entered in the Court of Appeal, the Federal High Court, from which the appeals emanated, ceased to have jurisdiction to entertain any matter pertaining to those cases that it had heard.

“What, therefore, simply happened in the Federal High Court today was that the counsel for Gov Umahi and the House of Assembly members informed the Court that the appeals have been entered in the Court of Appeal.

“He applied to withdraw the motions for stay of execution because new ones have also been filed in the Court of Appeal. Anything else that people are reporting is as a result of ignorance” he stated.
